Court Opinions and Arbitration Reports

We are happy to prepare opinions for official  courts of law.
Due to our training, we are familiar with the specifics of court and arbitration.

The cooperation between the expert and the court is regulated by the Code of Civil Procedure (ZPO). Thus, §§ 404a and 407a contain binding specifications for the purpose of the expert proof, which stipulate the obligations to ensure effective cooperation. Other paragraphs relate to the regulation of independent evidence.

Proof of Evidence

An expert is charged with the task of submitting an opinion in the context of court proceedings. In practice, he then, together with a short cover letter, receives the court files with the request to draw up an expert opinion in accordance with the evidence, sheet … of the files. The expert has to adhere strictly to this decision of the Court of First Instance and the questions referred to it.

Since the judge can be a layman in a technical and professional sense, it is sometimes not easy for him to formulate an expert and meaningful question. Where necessary, the Court of First Instance shall consult the expert before drawing up the question of proof, instruct him in his task and, upon request, explain the task to him. [QS1-01]
